State Laws
Colorado supports the broad use of telehealth across Medicaid and private insurance. State statute C.R.S. 10-16-123 defines “telehealth” and sets payer requirements, helping ensure coverage for services delivered virtually. In 2021, HB21-1190 updated the Medical Practice Act’s telemedicine definition to align with HIPAA-compliant technologies used for assessment and treatment.[3] Colorado Medicaid also maintains a Telemedicine & eConsult Billing Manual that details coverage and billing requirements for behavioral health services provided via telehealth.[6]
Prescribing via telemedicine. Providers must comply with federal law regarding controlled substances. In January 2025, the DEA announced new telemedicine rules intended to expand access and strengthen safeguards.[4] Until these rules are fully implemented, federal flexibilities regarding telemedicine prescribing will continue under federal guidance.[5] Clinicians should follow DEA requirements and any applicable Colorado rules when managing medications for substance use or mental health conditions.
